           Richard J. Arsenault, Co-Chair of Plaintiffs’ Executive Committee, and his firm, Neblett, Beard & Arsenault, LLP, have extensive complex litigation experience, including class actions against some of the Bayer defendants in this case.  Those cases include West v. G&H Seed Co., No. 99‑C‑4984‑A (Louis. 27th Jud. Dist. Ct.), a class action brought on behalf of Louisiana crawfish farmers who claimed that a pesticide developed by Aventis (later Bayer) damaged crawfish production.  The case was litigated through class certification for five years.  See West v. G&H Seed Co., 832 So.2d 274 (La. Ct. App. 2002).  Mr. Arsenault was part of a litigation team that negotiated a settlement after a five‑week trial, on the eve of closing arguments, resulting in a $45 million recovery.

Mr. Arsenault has been appointed to serve on numerous MDL committees around the country in a variety of capacities including lead and liaison counsel.  He has an AV Martindale-Hubbell rating and is listed in both the Bar Register of Preeminent Lawyers and the “Best Lawyers in America” peer-reviewed publications.  He also serves on the LSU Law Center’s Trial Advocacy Faculty and the National Law Journal has recognized Mr. Arsenault as having one of the nation’s largest personal injury verdicts.

At a recent class action fairness hearing in Eunice Train Derailment Litig., No. 6:00-CV-1267-Lead Case (W.D. La.), Harvard Law School Professor Arthur Miller, co-author of the leading treatise on federal practice and procedure, testified that Mr. Arsenault is one of the “leaders in the area of complex litigation.”  Likewise, Professor Edward Sherman, former Dean of Tulane Law School and author of a leading complex litigation treatise, has described Mr. Arsenault as one of the “experts” in class actions.

Mr. Arsenault has been invited to speak at a variety of complex litigation symposiums including those sponsored by Tulane Law School, the Louisiana Judicial College, and the U.S. 5th Circuit Judicial Conference.  Mr. Arsenault has also lectured and written extensively (over 200 articles and presentations) on class action, discovery, and related issues.  With a diverse career spanning over a quarter-century, Mr. Arsenault’s experience as a trial lawyer, author, speaker and teacher has provided a unique foundation for successfully navigating complex litigation.
